Brian shares his thoughts on recent events concerning the vaccine mandates and the recent Supreme Court opinions that affect the OSHA and CMS mandates. He breaks down the issues the courts are facing along with the historical context of the commerce clause and its impact on expanding the role of the federal government beyond its original limited, specific powers. Brian sees opportunities in front of the Supreme Court in 2022 to swing the pendulum from centralized federal control over policy to a return of the original intent of the States being “laboratories of democracy.”
Brian also addressed recent Alabama laws that provide protections against vaccine mandates and pending legislation that will expand those protections. He argued why he thinks the common “reasonable accommodation” of weekly testing and masking of those who seek an exemption from a vaccine requirement is not reasonable and could create further harm to both employees and employer.
